Terms of Service

Podi is developed and operated by PODI APP LLC. Last updated: October 9, 2026.

These Terms of Service (“Terms”) govern your use of the Podi mobile application and this website (together, the “Services”), operated by PODI APP LLC (“we”, “us”). Please read them carefully.

1. Acceptance of These Terms

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By using them, you represent that you meet this requirement and that you are not prohibited from using the Services under any applicable law.

3. Your Account

  • You are responsible for your account and for keeping access to it secure.
  • Provide accurate information and keep it up to date.
  • Do not share, sell, or transfer your account, and do not use another person’s account.
  • Tell us promptly if you believe your account has been compromised.

4. Acceptable Use

The Services exist for positive social connection. You agree to follow our Community Guidelines everywhere on the Services — in messages, live rooms, profiles, and the social feed.

5. Prohibited Activities

  • Harassment, bullying, hate speech, threats, or abuse of any person or group.
  • Sexual exploitation, and any content or conduct that endangers minors.
  • Illegal activity of any kind, or encouraging others to engage in it.
  • Impersonation, spam, scams, or other deceptive behavior.
  • Interfering with the Services — including attempts to access them through unauthorized means, probe or disrupt our systems, scrape data, or circumvent security or moderation measures.
  • Using the Services to collect other users’ personal information without their consent.

6. Your Content

You keep ownership of the content you create on the Services. By posting or sharing content, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and distribute that content as needed to operate and provide the Services. You are responsible for the content you share and must have the rights to share it.

We may remove or restrict content that violates these Terms or our Community Guidelines.

7. Messaging and Live Rooms

Live rooms are shared social spaces: what you say and do in a room is visible and audible to the people in it. Treat rooms with the same standards of behavior as every other part of the Services.

8. Virtual Items

The Services include virtual items and balances — such as virtual gifts and other digital content (“Virtual Items”). Virtual Items are digital content licensed to you for use within the Services; they are not money, have no cash value, and cannot be exchanged for money or anything of value outside the Services. Virtual Items may be changed, discontinued, or removed at our discretion, including when an account is terminated.

9. VIP Memberships

VIP and similar memberships unlock additional benefits within the Services. Benefits are described in the app, may change over time, and apply only while the membership is active.

10. Purchases and Refunds

How a purchase is processed depends on the version of the app you use, the store you obtained it from, and the payment methods actually available to you. A purchase made through an app store’s billing system is processed by that store, under that store’s terms and payment methods. Where we make another payment method available in your country, that purchase is handled by a third-party payment processor under its own terms. Except where required by law or by the applicable store’s policy, purchases of Virtual Items and memberships are final and non-refundable. Refund requests for store purchases are handled through the store’s own refund process, not by us.

If you are a consumer in the EU, the UK or another country with a statutory cancellation right

You normally have 14 days to withdraw from a purchase of digital content. Virtual Items and memberships are delivered to your account immediately after purchase, and by completing the purchase you ask us to begin supplying them at once and acknowledge that you lose that 14-day right once delivery has begun. This does not affect your rights if what you received was faulty or not as described.

11. Suspension and Termination

We may suspend or terminate accounts that violate these Terms, the Community Guidelines, or applicable law, or where necessary to protect the Services or their users. You may stop using the Services and delete your account at any time — see Delete Account.

If your account is closed — by you or by us — any unused Virtual Items and any remaining balances are forfeited and are not refunded or paid out. Deleting your account in the app is immediate and cannot be undone, so make sure you have finished anything you still want to do in the app before you delete it.

Sections that by their nature should survive termination (including licenses to stored content necessary to operate the Services, disclaimers, and limitations of liability) survive it.

12. Intellectual Property

The Services — including the Podi name, logo, design, and software — are owned by PODI APP LLC or its licensors and are protected by intellectual-property laws. Except as allowed by these Terms, you may not copy, modify, distribute, or create derivative works from the Services.

13. Third-Party Services

The Services rely on third-party services (such as app stores, sign-in providers, and communication infrastructure). Those services are governed by their own terms, and we are not responsible for them.

14. Copyright Complaints

If you believe something on the Services infringes your copyright, write to info@podi.click with: enough detail to identify the work you say was copied; where the material is on the Services; your contact details; a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law; a statement that the information in your notice is accurate and that you are the owner or authorised to act for the owner; and your signature. We remove infringing material and may close the accounts of repeat infringers.

15. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that content provided by users will be accurate or reliable.

16. Limitation of Liability

To the fullest extent permitted by law, PODI APP LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Services. To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose (or one hundred US dollars, if greater is required by law).

17. Changes to the Services or These Terms

We are always improving the Services, and features may change over time. We may also update these Terms; when we make material changes we will update the date above and provide notice through the Services. Continuing to use the Services after changes take effect means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.

19. If You Obtain Podi from the Apple App Store

These terms apply in addition to everything above, and only to the version of the app you obtain through Apple’s App Store.

  • These Terms are between you and PODI APP LLC only, and not with Apple. PODI APP LLC, not Apple, is solely responsible for the app and its content.
  • Your licence to use the app is a non-transferable licence to run it on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
  • PODI APP LLC, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession or use of it — including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar law.
  • PODI APP LLC, not Apple, is responsible for investigating, defending, settling and discharging any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, will have the right to enforce them against you.
  • Questions, complaints and support requests about the app go to info@podi.click — not to Apple.
